Terms and Conditions

All order reservations through Real Paella, whether by internet, phone or in-person, are subject to these Terms & Conditions. When you reserve a date through Real Paella you are confirming that you have fully read these Terms & Conditions, and agree to and are bound by them.

Terms & Conditions

BACKGROUND:
A. The Client is of the opinion that the Caterer has the necessary qualifications, licenses, experience and abilities to provide services to the Client.
B. The Caterer is agreeable to providing such services to the Client on the terms and conditions set out in this Agreement.

General Information and Policies
Our professional resources in culinary and service skills afford you complete assurance that all commitments will be carried out to your satisfaction. The staff of Real Paella will endeavor to make your event worry-free and enjoyable for client and all guests attending. In order to ensure you and your guests of a well-organized function, we must ask that we both adhere to the following catering policies:

Deposit / Acceptance of Terms
The deposit when applicable will apply towards the amount due and is non-refundable. The clients remaining balance must be paid in full on the day of the event. Reservations are not guaranteed until deposit is received. A final invoice will be emailed to the client 24 hours before the event. Deposits are non-refundable for events that are rescheduled or canceled.

Chef Fee and Cooking on-site
For any cooked on-site order the chef fee must be paid in full at the time of reservation and it is not refundable. Only authorized personnel are allowed in the cooking area, all customers must keep a distance of at least 6 feet. Please do not leave children and animals unattended around our cooking area.

Payment
Payment is due the day of the event. We now accept credit cards for the final payment with an additional 5% surcharge. We accept cash, check, or money order. Any checks should be made out to Real Paella. Final payments by credit card should be done the day before the event using the link in the invoice.

Taxes
All applicable state and local taxes will be imposed and paid by the client. If the client’s organization is tax exempt, the caterer must receive a certificate reflecting the client’s exemption status not later than five working days before the event. If the caterer does not receive this certificate, the client agrees to pay all taxes associated with the event.

Gratuity
19% (staff gratuity and sales taxes) will be applied to the final order. Any gratuities above this are at the sole discretion of the client.

Guarantees
Real Paella requires a guaranteed number of guests. If that number should increase/decrease by more than 20%, we must be notified in writing. A final guarantee of guests must be received in advance 48 hours before the day of the event. If attendance falls below the guaranteed number, the client will be charged for the guaranteed amount.

Menu
Your final menu selections are due no later than 72 hours prior to your scheduled event.
Caterer reserves the right to make small changes to the menu if key ingredients exceed reasonable market costs or are unable to be sourced due to reasons beyond the control of both parties.

Food Allergies
Real Paella will not be responsible for providing food for people with allergies. It is the responsibility of the client to inform all guests that our food may contain nuts/peanuts or fish/shellfish ingredients in our kitchen at any given time.

Employee Hygiene
Real Paella always provides clear hygiene standards regarding personal and hand hygiene, glove use, work attire, and sick policy to our employees and contractors, and always puts our best effort ensuring that our staff understand and always follow these rules. At Real Paella we believe in a healthy work environment meeting the highest standards of hygiene and compliance with the law.

Recycling
Real Paella is a zero-waste business and it is our company policy to ensure a high level of commitment to good environmental policies throughout our business activities to minimize waste as much as possible by always encouraging employees in our company and other vendors on our events to promote and establish recycling schemes.

Live Music
Live music bookings require payment in full at the time of reservation.

Services Provided
The Caterer agrees to provide the client with services as specified in the Proposal.
The Services will also include any other tasks which the parties may agree on. The Caterer hereby agrees to provide such Services to the client.

Portion Sizes
Our menu items are sold on a per guest basis, with portion sizes having been determined by our experienced catering staff. If you would like information regarding exact quantities, please do not hesitate to ask our catering coordinator.

Confidentiality
The Caterer agrees that they will not disclose, divulge, reveal, report or use, for any purpose, any confidential information with respect to the business of the client, which the Caterer has obtained, except as may be necessary or desirable to further the business interests of the client. The Caterer further agrees that they will not disclose, divulge, reveal, report or use, for any purpose, any personal information of the client, without the prior written consent of the client. This obligation will survive indefinitely upon termination of this Agreement.

Permits/Licenses
In the event that the client’s function requires a permit or license from any governing body, local, state or federal, the client is solely responsible for obtaining such license or permit at client’s expense.

Liability
Caterer and/or its agents will be liable for any damage or loss to property caused by its employees. Patron assumes responsibility for any damages to any property rented to patron that may be caused by patrons, members, guests or invitees.
Caterer shall have no responsibility or liability for failure to supply any services when prevented from doing so by strikes, accidents or any cause beyond Caterer’s control, or by orders of any governmental authority.

Venue, Costs and Legal Expenses
In the event that legal action is brought to enforce or interpret any term of this Agreement, the parties agree that Venue shall be in Florida and that the prevailing party shall be entitled to recover, in addition to any other damages or award, all reasonable legal costs and fees associated with the action.

Performance
The parties agree to do everything necessary to ensure that the terms of this Agreement take effect.
The agreement coincides with the CATERING ORDER which outlines the exact type of food, times and equipment to be provided by caterer for patron. A copy of the CATERING ORDER must accompany this agreement to make it whole.

Weather
The Caterer reserves the right to determine whether outdoor on site cooking can occur at an event. Unsuitable wind or weather conditions will be taken into consideration prior to and during the event, and if the weather is inclement and poses a hazard or limitations to cooking the full order, the Caterer will bring the order already cooked to serve. The Caterer will make this determination within 12 hours before the event. In the event of disruption or cancellation of an event due to a weather event the client shall nevertheless be obligated to pay all amounts due to Real Paella and shall not be entitled to any refund.
